Soul Fire Yoga LLC Release and Waiver of Liability Agreement

 

This Release and Waiver of Liability ("Agreement") is entered into by the undersigned participant ("Participant") in favor of Soul Fire Yoga LLC, an Indiana limited liability company, and its owners, instructors, employees, agents, contractors, and affiliated parties ("Released Parties").

1. Acknowledgment of Activities

I, (participant), acknowledge that I am voluntarily participating in yoga classes, health programs, workshops, physical therapy, bodywork, breathwork, fitness training, and other wellness activities (collectively, “Activities”) offered by Soul Fire Yoga LLC (“Studio”). These Activities may be conducted in person, online, or through digital platforms including video, livestream, app, or other remote formats. All such offerings are included in the definition of “Activities.”

2. Physical Condition and Participation

I represent and warrant that I am physically and mentally capable of participating in the Activities. I understand the Activities may involve strenuous physical movement, stretching, and exertion that could exacerbate a medical condition or result in new injury. I affirm that I have either consulted with a qualified medical professional or knowingly assume the risks without such consultation. I understand the Studio reserves the right to refuse my participation for any reason, including but not limited to health and safety concerns.

3. Risk Acknowledgment

I am aware that participation in the Activities carries inherent risks, including but not limited to muscle strain, sprains, cardiovascular events, fainting, or aggravation of existing conditions. I accept full responsibility for knowing and respecting my physical limits and for ceasing activity should I feel pain, discomfort, or fatigue.

4. Assumption of Risk

In consideration of being permitted to participate, I voluntarily assume all risks—known or unknown, foreseeable or unforeseeable—associated with the Activities, including those that may arise from the negligence of the Released Parties.

5. Waiver and Release

To the fullest extent permitted by Indiana law, I hereby knowingly, voluntarily, and expressly waive, release, and discharge the Released Parties from any and all claims, demands, causes of action, costs, expenses, or liabilities of any kind (collectively, “Claims”) arising from or related to my participation in the Activities, including claims of negligence. This waiver applies to any injury, loss, or damage I may suffer, including but not limited to physical injury, emotional distress, or death.

6. Indemnification

I agree to indemnify, defend, and hold harmless the Released Parties from any Claims brought against them by me or any third party acting on my behalf, even if such claims arise from the negligence of any Released Party.

7. Media Release

I understand that the Studio may take photographs, videos, or other recordings during classes or events. I consent to the use of my likeness, image, or voice for marketing or promotional purposes in any media, without compensation.

8. Choice of Law and Venue

This Agreement shall be governed by and interpreted under the laws of the State of Indiana. Any disputes arising under this Agreement shall be resolved in the state or federal courts located in St. Joseph County, Indiana. If any portion of this Agreement is held invalid, the remaining provisions shall remain in full force and effect.

9. Knowing and Voluntary Execution

I acknowledge that I have read this Agreement in full, understand its terms, and sign it voluntarily without inducement. I understand that I am giving up substantial legal rights, including the right to sue the Released Parties.
